Stock News 2013: Supreme Court affirms dismissal of civil case vs SM Prime Holdings

The Supreme Court affirmed the decision of the Pasig City Regional Trial Court in dismissing the civil case filed against SM Prime Holdings Inc. for non-payment of P76.8 million amusement tax incentive reward from 2003 to 2008.

In a decision by the high court’s first division through Associate Justice Martin Villarama, the Pasig Court’s ruling is proper and does not indicate that it is abdicating its jurisdiction over the case.

The Film Development Council of the Philippines filed the case against SM to collect the P76,836,807.08 from SM Cebu.

The civil case in Cebu, meanwhile, was filed by the Cebu City Government seeking to declare as invalid a provision of Republic Act 9167 or the law creating the Film Development Council of the Philippines which requires cities and municipalities in Metropolitan Manila and highly urbanized cities nationwide to deduct from theaters and cinemas amusement tax that will be used as reward for film producers who can make high quality films.

Cebu City government argued that the provision violates the Local Government Code specifically the provision which gives LGUs taxing power.

SM sought to dismiss the case filed in Pasig saying it has been religiously remitting amusement tax to the Cebu City government and informed the court of a similar case in Cebu, adding that its motion for intervention with the Cebu Court has been granted.

The Pasig Court granted SM’s motion to dismiss on the ground that there is a pending case in a Cebu Court.

The high court in its ruling agreed with the Pasig Court’s ruling that the Cebu Court is in the best position to rule over the case.

“A party is not allowed to vex another more than once regarding the same subject matter and for the same cause of action. This theory is ‘founded on the public policy that the same subject matter should not be the subject controversy in courts more than once, in order that possible conflicting judgments may be avoided for the sake of the stability of the rights and status of persons and also to avoid the costs and expenses incident to numerous suits,” the high court said.

Stock News 2012: FLI allots P5 B for Cebu BPO project

Gotianun-led Filinvest Land Inc. (FLI) is pouring in P5 billion to convert a 1.2 hectare property in Cebu into a modern office complex catering to the business process outsourcing (BPO) sector in the area.

FLI president Joseph Yap said the complex, which would rise on a lot that used to be occupied by the Bagong Buhay Rehabilitation Center and the Cebu City Treatment and Rehabilitation Center in Salinas Drive, Lahug, would comprise four buildings which are expected to provide an additional 87,000 square meters to its office portfolio when completed.

The company is spending P640 million to construct the first building.

Yap said the company remains bullish on the BPO sector and is rapidly expanding its office portfolio to meet the needs of the industry.

By 2012, FLI will have an office portfolio of over 178,000 sqm in terms of gross leasable area, making it one of the biggest office landlords in the country. The figure is expected to increase further to 371,000 sqm by 2016 or 108 percent higher.

As of the end of 2011, FLI’s BPO office building portfolio had over 170,000 square meters of gross leasable area (GLA) from 12 buildings in Northgate Cyberzone in Filinvest Corporate City in Muntinlupa City and PBCom Tower in Makati City.

At Northgate Cyberzone, another building is currently under construction and would add close to 20,000 square meters of GLA in the first half of 2013, while a 14th building is targeted to break ground within the year with a GLA of 13,000 square meters.

Vector Two, which was completed in the fourth quarter of 2011, is fully taken-up and has been turned over for tenant fit-outs.

Aside from this, FLI is constructing a five-story building along EDSA across the Asian Development Bank building, and it is expected to be completed within the year.

Cebu has become one of the major hubs for FLI projects. It is currently developing the 50.6-hectare Citta di Mare in the South Road Properties

Stock News 2011: Robinsons Land to build 200-room Mactan hotel

Robinsons Land Corp. is set to build a 200-room deluxe seafront hotel in Mactan, Cebu, raising its stake in tourism in the country’s biggest commercial hub outside Metro Manila.

During Friday’s listing on the Philippine Stock Exchange of P13.65 billion worth of shares recently sold through a stock rights offering, RLC president Frederick Go told reporters that the new hotel would be called “Summit Shores” and would cater to both leisure and convention tourism.

The new hotel is in the planning stage and construction can start this year. It will occupy two hectares out of RLC’s five-hectare leisure estate development Amisa in Mactan along the same row as the plush Shangri-La and Movenpick Resort & Spa (formerly Hilton).

The upcoming hotel would be finished in two years, Go said. It would offer hotel rooms for $100 to $120 a night and would be more of a sprawling type of hotel-resort with a large convention facility than a high-rise development, Go said.

The Mactan hotel will be the fifth among RLC’s portfolio of deluxe hotels and the second in Cebu after an earlier hotel in Cebu City formerly called Cebu City Midtown Hotel. The group also owns the Galleria and Crown Plaza hotel properties in the Ortigas central business district and Summit Ridge in Tagaytay.

Stock News 2010: FLI ramps up Cebu project

MANILA, Philippines – Filinvest Land, Inc. (FLI), the property development arm of the Gotianun family, is ramping up its projects in Cebu.

The firm said it recently broke ground on the first of its mid-rise building (MRB) projects within Citta de Mare, in the South Road Properties, Cebu.

Amalfi Oasis is one of the mid-rise building communities FLI is developing within the 50.5-hectare Citta de Mare, under a joint venture with the Cebu City Government.

FLI held ground breaking ceremonies last November 13 for Amalfi Oasis’ first of 10 to 12 buildings. The first tower will have 150 units and should be ready for turnover to buyers by the end of 2011.

By February, 2011, FLI targets to break ground on its second project in Citta de Mare, San Remo Oasis. It will have a total of eight buildings, with the first having 130 units.

Stock News 2009: Philippines' RLC Opens Robinsons Cybergate Cebu Complex

Robinsons Land Inc. (RLC, PSE:RLC) has opened its multi-million-peso Robinsons Cybergate Cebu, a mixed-use project that fuses office, wellness and retail into one development.
Robinsons Cybergate Cebu is the newest is the newest high-rise building around the Fuente Osmena rotunda in the heart of Cebu City and is just across the Robinson mall and Cebu Midtown Hotel.
RLC general manager Nilo Mapa Jr. said the project is a testament to the companys intention to expand its presence in Cebu.
Momot Irizari, RLC-Cebu group property manager for the commercial centers division, said 80 percent of leasable space of the seven-story building is already booked.
RLC is still negotiating with various business process outsourcing (BPO) companies for its 6,300-square-meter space allocated for a call center operation.
Hopefully, by the end of the year we will be able to sign a deal with a company for the BPO space, she said.
She said that right now, inquiries come from BPO players that have existing operations in Cebu and those that have yet to locate here.
But RLC is open to have more than one BPO locator to occupy the fifth to seventh floor of the building, depending on the need of the company.
Since the call center is open on a 24-hour shift, some of the retail and food tenants have also agreed to operate 24/7, like the pharmacy, convenience stores and the coffee shop.
The first two floors of the Robinsons Cybergate Cebu features food and retail outlets, including homegrown restaurants Mooon Cafe, Flame It and Golden Cowrie. The second level also features a food court, where food kiosks and carts are located.
The third floor of the building is dedicated to its wellness component and this includes salons and spa operators.
The fourth floor is where the medical clinics are found and Irizari said a number of medical practitioners are going to open clinics there, ranging from internal medicine doctors, obstetricians, dentists and orthopedics.
Although the structure is already 100 percent complete, some finishing touches and final fit-outs have yet to be done. RLC is looking at holding a grand opening or a building inauguration by the third quarter of 2010.
Irizari said RLC is already looking ahead to the start of initial ground work for a similar development at the North Reclamation Area in Cebu City.
The development of RLCs 45,000-square-meter property, located near the old White Gold department store, is set to open in 2011.
Though still a mixed-use project, it will have a different concept from the Robinsons Cybergate Cebu.
Irizari said the still unnamed project will have a supermarket, department store, al fresco dining, a serviced-apartment component and a convention center.
